1. Introduction

Welcome to AI-BOB AB ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of our services. By using our services, you agree to these Terms, our Privacy Policy, and our Data Processing Agreement ("DPA"). If you do not agree, please do not use our services.

AI-BOB provides an AI service that automates compliance checks for building regulations, customer specifications, and data quality within architectural models and project documentation.

3. Description of Services

AI-BOB AB provides AI-powered tools that support architects and property developers in achieving regulatory compliance and industry best practices. Our services are accessible through our web application and plugins, enabling the review of construction models and documentation.

You acknowledge that our services are support tools only and do not replace professional judgment or the need to comply with all applicable laws and regulations. The final responsibility for project compliance remains with you, the user.

4. Service Access and Payment

Access to AI-BOB's services requires a paid agreement. Details of pricing, subscription terms, and payment methods will be specified in a separate service agreement. Failure to pay fees, a breach of our agreements, or misuse of the services may result in immediate suspension or termination of your access.

5. User Accounts

To use our services, you must create an account. You agree to:

  • Provide accurate, complete, and up-to-date information.
  • Maintain the confidentiality of your account credentials.
  • Be fully responsible for all activity conducted under your account.
  • Not share, sublicense, or transfer your account access without our written consent.

We reserve the right to suspend or terminate any account that violates these Terms or poses a security, legal, or operational risk.

6. User Conduct and Breach of Terms

By using our services, you agree to comply with acceptable use defined below. A material breach of these Terms is considered to have occurred if the user:

  • Uses the service in violation of applicable law or the intended purpose of the agreement.
  • Knowingly circumvents technical protections or attempts to manipulate the service.
  • Shares or distributes login credentials to unauthorized third parties.
  • Uses the service for automated decision-making in critical processes without human review and oversight.
  • Commits any other act detailed as unacceptable.

7. Data, Privacy, and Security

Your privacy and data security are critically important to us. Your use of our services is subject to our Privacy Policy and Data Processing Agreement (DPA), which are incorporated into these Terms by reference.

  • Data Ownership: You retain full ownership of all data, content, and models you upload to the service ("Your Data").
  • Our Role: We act as a "Data Processor" for any personal data contained within Your Data, processing it only on your documented instructions to provide and improve the service, as detailed in our DPA.
  • License to Us: You grant AI-BOB a limited, non-exclusive license to access, use, and process Your Data solely for the purpose of operating, maintaining, and improving our services for you. We may use anonymized and aggregated data to enhance our systems, but never in a way that identifies you or allows for your specific data to be reverse-engineered.
  • Your Responsibility: You are solely responsible for the legality, integrity, and accuracy of Your Data and for ensuring you have the necessary rights to use it with our services.
  • Security: We implement and maintain robust administrative, technical, and organizational safeguards to protect Your Data.

8. Intellectual Property

All content and materials that are part of our services, including but not limited to text, graphics, code, and logos, are the intellectual property of AI-BOB AB and are protected by applicable intellectual property laws. Unauthorized use of our materials is strictly prohibited.

9. Termination

  • Termination by Us: We reserve the right to suspend or terminate your account and access to our services if you commit a material breach of these Terms or our Acceptable Usage Policy.
  • Termination by You: You have the right to terminate the agreement with immediate effect in the event of a material breach of the agreement by AI-BOB AB. In such cases, you may be entitled to compensation for direct damages as specified in Section 10.

Termination does not affect any rights or remedies available to either party.

10. Disclaimers and Limitation of Liability

Our services are provided "as is." While we strive to provide a high-quality service, we do not warrant that it will be uninterrupted or error-free.

AI-BOB's liability for damages arises in cases of negligence or gross negligence on our part, or if the damage is caused by errors, lack of availability, or security flaws in the service. Our liability is limited as follows:

  • Direct Damages: AI-BOB is liable for direct damages, including reasonable costs for data recovery and other additional costs incurred as a result of errors or deficiencies in the service. Our total liability for all damages arising under this agreement during any given year is limited to a sum equivalent to 20% of the total contract value paid by you during that year.
  • Indirect Damages: We are not liable for any lost profits, loss of business opportunities, or other indirect or consequential damages, except in cases of gross negligence or willful misconduct.
  • Service Unavailability: If the service is unavailable for a continuous period longer than forty-eight (48) hours, you are entitled to a price reduction proportional to the duration of the unavailability.

11. Indemnification

You agree to indemnify and hold AI Bob AB, its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the services or your violation of these Terms. You agree to indemnify, defend, and hold harmless AI Bob AB, its affiliates, officers, directors, employees, agents, and contractors from and against any and all:

  • Claims, demands, lawsuits, or proceedings;
  • Liabilities, damages, losses, and costs;
  • Expenses, including without limitation reasonable legal and accounting fees, that arise out of or relate to:
  • Your access to or use of the Services;
  • Your violation or alleged violation of these Terms;
  • Your data, content, or materials provided through the Services;
  • Your violation of any applicable laws, regulations, or third-party rights. You are responsible for all costs and damages resulting from such claims, including costs incurred by AI Bob AB in defending or resolving them.

12. Governing Law

These Terms shall be governed by the laws of Sweden. You agree to submit to the exclusive jurisdiction of the courts in Stockholm, Sweden, to resolve any dispute arising from these Terms.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. When we make material changes, we will provide reasonable advance notice, which may include posting the updated Terms on our website, sending you an email, or displaying a notice within the Services. For non-material updates, we will update the “Last Updated” date at the top of these Terms, and we encourage you to review the Terms regularly. Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Services before the effective date of the updated Terms.
